1. Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of EverScans ("we," "us," "our"), including our website at everscans.com, our QR code generation and management tools, URL shortening services, and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

EverScans provides tools to create static and dynamic QR codes and shortened URLs. Static QR codes and short links point to a fixed destination that cannot be changed after creation. Dynamic QR codes allow the destination to be updated after creation without changing the printed or shared code. We also provide scan and click analytics, subject to the limits of your subscription plan.

3. Accounts

To access certain features, you must create an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity that occurs under your account.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account.

4. Acceptable Use

You agree not to use the Service to create, host, or redirect to content that:

• Is illegal, fraudulent, deceptive, or facilitates phishing or malware distribution
• Infringes on the intellectual property or privacy rights of others
• Contains malicious code or is intended to harm any system or user
• Promotes violence, harassment, or hate speech
• Violates any applicable local, national, or international law

We reserve the right to deactivate any QR code, short link, or account that violates these Terms, without prior notice.

5. Plans and Billing

EverScans offers a free Starter plan and paid Pro and Business subscription plans. Paid plans are billed on a recurring basis (monthly or yearly, as selected) through our payment processor. By subscribing to a paid plan, you authorize us to charge your chosen payment method on a recurring basis until you cancel.

6. Plan Limits

Each plan is subject to limits on the number of dynamic and static QR codes, short links, and monthly scans/clicks, as described on our Pricing page. We reserve the right to pause detailed analytics tracking, or to deactivate codes or links that exceed your plan's limits, in accordance with the terms displayed at the time of use.

7. Intellectual Property

The EverScans name, logo, website design, and underlying software are our property or that of our licensors. You retain ownership of the content and destinations you link to through your QR codes and short links. You grant us a limited license to store and process this content solely to provide the Service.

8. Service Availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may suspend or modify the Service for maintenance, updates, or reasons beyond our control. We are not liable for losses resulting from downtime.

9. Limitation of Liability

To the maximum extent permitted by law, EverScans and its team shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, revenue, or business opportunities.

10. Termination

You may deactivate your account at any time from Settings. We may suspend or terminate accounts that violate these Terms. Upon deactivation, your account and data are retained for 30 days before permanent deletion, during which you may reactivate by logging back in.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
